MOSCOW, 21 February, 1996 (GP) Today the Russian Federation
Supreme Court held the first hearing of suit brought by
Greepeace against the Russian President. Greepeace wants the
Regulation cancelled that permits construction of a spent
nuclear fuel reprocessing RT-2 plant and fuel imports from
foreign NPPs.
Greenpeace believes the Decree "About the state support of
structural reorganization and conversion of nuclear industry
in Zheleznohorsk town, Krasnoyarsk Kray" No. 72 of the Russian
President dated 15 January 1995 runs in contrast to the valid
Environment Protection Law. So, the Decree grants the permit
of spent nuclear fuel import to Russia disguised as a delusive
formulation "with purpose of further processing" that implies
actually "with purpose of storing" that is strictly prosecuted
by the Article 50 part 3 of the RF Act "About the Environment
Protection". By issued Decree the President gave right to
transfer funds to the construction of spent nuclear fuel
reprocessing RT-2 plant with evasion of the Article 41 of the
Law demanding resolutely the execution of ecological expertise
of such projects prior to financial authorization. The first
application against Decree was put in a court as long ago as
April, 1995. For about six months the Russian femida couldn't
decide what court a case is to be considered in. A long
argument between the Basmanny and Khamovnichesky courts had
been taking place as regards "location" of the President
since the Kremlin, the formal residence is not his location as
"suddenly" it turned out. Finally, due to some changes of
legislation the Supreme Court of RF attended the consideration
of suit.
